 I don't see CODA (2021) as a remake of The Departed (2006). The two have completely different stories. However, CODA is an English-language remake of the 2014 French film  La Famille Bélier (2014) as the stories are basically the same.

 The Departed (2006) is a remake of Infernal Affairs (2002), original title: Mou gaan dou (2002)

That's what is meant. CODA is like Departed in that both are remakes of foreign films.

FYI, depending on how you define a remake, the number of English-language remakes of films previously and originally made in a foreign-language might be as high as four.

Oscar Best Picture Nominee CODA (2021) is an English-language remake of the 2014 French film The Family Belier aka La Famille Bélier (2014).

Oscar Best Picture The Departed (2006) is an English-language remake of the 2002 Hong Kong film, Infernal Affairs (2002) aka Mou gaan dou (2002).

Oscar Best Picture Nominee Les Misérables (2012) is an English-language remake of the 1934 French film, Les Misérables (1934).

Oscar Best Picture Nominee  Les Misérables (1935) is an English-language remake of the 1934 French film, Les Misérables (1934).

I think Urb was referring to the comment about CODA as "a second instance of a Foreign film remake as a Best Picture." 

I believe ElM is saying that it would be the second remake of a foreign film to win. Urb (and I) pointed out other nominees that didn't win.
